Latvia to pay European Commission EUR 300 000 fine

Latvia will have to pay a fine of EUR 300 000 to the European Commission (EK) for failure to comply with the Council of Europe Directive in the field of electronic communications, as LETA found out from the Court of Justice of the European Union.
The EC filed a claim against Latvia for non-compliance with the Treaty on the Functioning of the European Union (TFEU) on the 8th of July, 2022. The EC asked the court to establish that by failing to adopt all the laws, regulations and administrative provisions necessary to comply with Article 124 (1) of the Directive on the establishment of the European Electronic Communications Code, or in any case by failing to notify these provisions to the EC, Latvia has failed to fulfil its obligations under this Directive.
EC notes that pursuant to the third paragraph of Article 288 TFEU, member states are to adopt the provisions necessary to ensure the transposition of the directives into national law within the time-limits laid down in those directives, and they are to be notified to the EC without delay.
The aim of the directive is to introduce an internal market in electronic communications networks and services that results in the deployment and deployment of very high capacity networks, sustainable competition, interoperability of electronic communications services, accessibility, security of networks and services and end-user benefits.
The directive also aims to ensure high-quality, low-cost, publicly available services throughout the European Union through effective competition and choice, to prevent conditions where the needs of end-users, including end-users with disabilities, are not sufficiently met by the market to enable them to access services on an equal basis with others, and to establish the necessary end-user rights.
